Article 1: Acceptance

These general conditions of sale are concluded on the one hand by SARL HDC, with its registered office at 28 Traverse Parangon – 13008 Marseille - France (Siret No.: 79323044200030), hereinafter referred to as "the Seller", and on the other hand, by any natural or legal person wishing to make a purchase via our website, hereinafter referred to as "the Customer".
The Customer acknowledges being of legal age and authorized by the legislation of their country to purchase products sold on our website.
The GTC may be modified at any time and without notice by HDC, the modifications then applying to all orders subsequent to this modification.

Article 2: Products

The products and services offered are those listed in the catalog published on our website. These products and services are offered subject to available stock.
In the event that one of the ordered products is not available during the preparation of the Customer's order, HDC commits to contacting the Customer by email as soon as possible from the date of their order to indicate within what timeframe this product can be delivered, it being specified that the Customer has the right to cancel their order.
In case of impossibility to supply a product, it will be proposed to the Customer to exchange it for another product with equivalent characteristics and price or a credit equal to the amount of the unavailable products ordered. In case of cancellation of the order of the concerned product by the Customer, the refund of the unavailable product will be made at the latest within fifteen days after the receipt of the amounts paid by the Customer.
The products offered on our website comply with French legislation and the applicable Community regulations. HDC's responsibility cannot be engaged in case of non-compliance with the legislation of the country in which the product is delivered. It is the Customer's responsibility to check with the local authorities of the country of delivery of the products the possibilities of importing or using the products they intend to order. HDC cannot guarantee that the information written on the product packagings is translated into all the languages of the European Union.

Article 3: Payment of orders

The Customer declares to have the capacity to conclude this contract, that is to say, to be of legal majority and not to be under guardianship or curatorship.
The prices indicated on our website are prices including all taxes in euros.
The products are sold to the buyer according to the rate in effect on the day of the order. The seller may, however, make a change to its rates at any time but the products ordered will be invoiced at the price in effect at the time of the order. The indicated prices are exclusive of transportation and delivery costs.

No partial payment is accepted by the seller, the merchandise is payable in full at the time of order, unless stipulated otherwise.
No delivery can be made before the receipt of the amounts due.

The buyer may pay for their order by Credit Card or Bank Transfer.
Regarding payments by credit card, no banking information of the buyer will be known to HDC.
All validated orders are transmitted in real-time to the preparation service. No modification of the order is possible at this stage.
The order placed on our website is automatically cancelled if payment is not received within a period of 6 days.

Article 4: Delivery of orders

The ordered products are delivered to the delivery address indicated during your order, the delivery address can be different from your billing address.
Any package returned to HDC due to an incorrect or incomplete delivery address, or because the Customer did not collect it from the depositary within the allotted time, will be resent at the Customer's expense.
HDC commits in case of damaged delivery to replace the defective
product(s) upon presentation of a photo of the packaging as well as the clearly identifiable products.
In case of international sale, HDC cannot be held responsible for a blockage by customs in the country of destination and no compensation can be requested from the sender in case of seizure or blockage.
The delivery times are given only as an indication by the carrier.
Consequently, in case of non-respect of these deadlines, the Customer will in no case be entitled to claim the payment of damages and interests from the seller, nor to make any deduction or cancel the orders in progress.

Article 5: Right of withdrawal

In accordance with Article L. 221-28 of the Consumer Code, you have the right to withdraw from this contract without giving any reason within fourteen days from the date of receipt of the product (excluding e-liquids and aromas) to return at your own expense.

To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, a letter sent by post or via the contact tab on our website).

Article 6: Legal warranty of conformity

The products sold by HDC are covered by the legal warranty of conformity (Articles L211-1 and following of the Consumer Code).

The Consumer Code imposes on the seller the obligation to deliver goods in accordance with the contract. The lack of conformity represents a failure to meet this obligation. However, the seller is only responsible for conformity defects that existed at the time of delivery of the goods. Defects that were not present at the time of delivery and only affected the item later do not fall under the warranty.
HDC reserves the right to refuse the warranty claim for any product showing obvious signs of improper use, or damages after purchase (impacts, scratches...) The Customer must make a return request in writing via the contact tab on our site. Upon receipt of the return request, a written confirmation with the procedure to follow will be communicated to the Customer.
The product must be returned in its original packaging with the original accessories and instructions.

Article 7: Liability

The consumer is expressly informed that HDC is not the manufacturer of the products. Consequently, in case of damage caused to a person or property by a product defect, only the responsibility of the manufacturer of it can be sought by the consumer.

Article 8: Intellectual Property

All elements of our site are and remain the intellectual and exclusive property of HDC. No one is authorized to reproduce, exploit, redistribute, or use for any title whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text without the express consent of the owner.
The photos present on the site are non-contractual.

ARTICLE 9: Personal Data

In accordance with the law relating to information technology, files, and freedoms of January 6, 1978, the personal information relating to buyers may be subject to automated processing. HDC reserves the right to collect information on buyers including using cookies, and, if desired, to transfer collected information to commercial partners.
Customers have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.

Article 10: After-sales Service

All claims must be made through the contact form on the site.
Any return of a product must be subject to the express agreement of HDC.
Products must be returned in perfect condition and in their original packaging with all possible accessories.

Article 11: Applicable Law

These general conditions are subject to French law.
In the absence of an amicable agreement, any dispute relating to the interpretation, execution, breach of the contract concluded between the Seller and the Customer, will be submitted to the competent court under the conditions of common law.

The sale of electronic cigarettes, accessories for them, liquids, or e-liquids is prohibited to minors. By accepting these conditions, you certify to be over 18 years old.
